By accessing the SHAPE website or engaging SHAPE for design, pre-construction, manufacturing, delivery, or installation of an Accessory Dwelling Unit (ADU) or single-family home, you agree to be bound by these Terms of Service. If you do not agree, please do not use the site or our services.
SHAPE provides architectural design, engineering, permitting support, modular fabrication, and construction services for residential ADUs and single-family homes in California. Specific scope, deliverables, schedule, and pricing for any project are governed by a separate written agreement signed by both parties. Information on this website is for general informational purposes only and is not a binding offer.
Any pricing shown on the site is an estimate based on typical configurations. Final project pricing is set in your signed construction agreement and may vary based on site conditions, soils and geotechnical reports, utility connections, jurisdictional requirements, design selections, and material availability. Allowances for finishes, appliances, and fixtures are non-binding until selections are confirmed.
SHAPE will use commercially reasonable efforts to support permit submittal and approvals; however, all permits are issued at the sole discretion of the applicable city, county, or building authority. SHAPE does not guarantee permit timelines, design-review outcomes, HOA approvals, or zoning interpretations. Client is responsible for any required HOA, easement, or third-party approvals not handled by SHAPE in writing.
Client warrants that they own (or have legal authority over) the property, that the site is accessible to construction crews and a flatbed delivery truck, and that they will disclose all known site conditions including but not limited to easements, setbacks, drainage issues, septic systems, protected trees, and underground utilities. Unknown conditions discovered during construction may result in change orders.
SHAPE provides a one (1) year workmanship warranty from the date of substantial completion on labor performed by SHAPE and its subcontractors, and passes through all manufacturer warranties on appliances, fixtures, windows, doors, roofing, and mechanical equipment. The warranty does not cover damage caused by misuse, neglect, modifications by others, settling, weather events, or normal wear and tear.
SHAPE is a licensed California contractor (CSLB #1158688) and maintains general liability and workers' compensation insurance. Certificates are available upon request.
All architectural drawings, renderings, specifications, photographs, and content on this site are the property of SHAPE and may not be copied, reproduced, or used without written permission. Designs prepared for a Client remain SHAPE's intellectual property and are licensed to the Client solely for the construction of the contracted project.
To the maximum extent permitted by law, SHAPE's total liability for any claim arising out of the use of this site or any project shall not exceed the amounts actually paid by the Client to SHAPE under the applicable agreement. SHAPE is not liable for indirect, incidental, consequential, or punitive damages.
Any dispute arising out of or relating to these Terms or our services shall first be addressed through good-faith negotiation. Unresolved disputes will be submitted to binding arbitration administered by JAMS in Santa Clara County, California, in accordance with its construction industry rules. California law governs.
SHAPE may update these Terms from time to time. Updated Terms become effective when posted on this site. Continued use of the site or services after changes constitutes acceptance.
